Privacy Policy

This Privacy Policy (“Privacy Policy” or “Policy”) describes how Personal Information is collected, used, and shared by Vi Labs Ltd. (together with our subsidiaries and affiliates, “Vi Labs” “we,” “us” or “our”), as well as the rights and choices individuals may have regarding such Personal Information. “Personal Information” is information that identifies you as an individual or relates to an identifiable individual.

This Privacy Policy applies to Personal Information we collect when you visit our website at https://vi.co or engage with us in other related ways, including any sales, marketing, or events. It also describes our data practices in connection with our data solutions and consumer analytics products (“Data Services”), as described further below. 

In some instances, Vi Labs provides services to business customers where we process Personal Information on their behalf as a “processor,” as defined under data protection laws. When we process Personal Information on behalf of those customers in those circumstances, their privacy policy — not this one — governs. In such cases, please contact that organization (e.g., your health care provider) for questions about their privacy practices.

While our processing of Personal Information varies based upon our relationship and interactions with you, the categories of Personal Information that we collect and have collected in the prior 12 months are described in the tables below.

HOW DO WE USE YOUR PERSONAL INFORMATION?

Although the purposes for which we may process Personal Information will vary depending upon the circumstances, generally, we may use the above categories of Personal Infomation for the following business and commercial purposes:

  • Providing our services. To provide and maintain our services, including the Data Services, as described in the “Data Services” section of this Privacy Policy, fulfilling and processing payments and billing; providing technical support; and for other customer service and support purposes.
  • Communicating with you. To communicate about our products and services, including sending you notices and alerts, and responding to your requests.
  • Promoting products and services, including to deliver targeted advertising and relevant marketing materials.
  • Improving and optimizing our website and services, including to improve the Data Services by conducting internal research, to generate analytics about how our customers browse and interact with our website, and to screen for potential risk and fraud.
  • Complying with legal requests and obligations. We may disclose Personal Information to comply with the law or legal proceedings pursuant to applicable statutes and regulations in response to subpoenas, judicially signed court orders, warrants or other lawful requests including responding to national security or law enforcement.
  • With your consent or as otherwise disclosed at the time of collection. 

We “sell” Personal Information and “share” Personal Information for cross-context behavioral advertising or targeted advertising purposes, as such terms are defined by applicable laws. We do not knowingly “sell” or “share” Personal Information of minors under 16 years of age.

We do not process the sensitive Personal Information we collect for purposes that require us to offer a right to limit, as such terms are defined by the CCPA.

Data Services

Vi Labs provides consumer analytics and data solutions to customers operating in the healthcare, wellness, and pharmaceutical spaces. As part of the provision of the Data Services to our customers, Vi Labs processes Personal Information for the following purposes: 

  • Providing marketing information to our customers, such as identifying customers or prospective customers that may be interested in certain products or services, how to contact those customers, and providing insights about customer behavior. 
  • Targeted advertising by providing custom audiences to our customers, containing MAIDs and hashed email addresses, and working with data partners to measure the effectiveness of ad campaigns. 
  • Conducting marketing research to help our customers understand specific markets and their target audiences as well as market opportunities in different geographic regions. 
  • General marketing services, including optimizing and measuring the effectiveness of advertising campaigns; and analyzing, updating, and optimizing our customers’ databases. 

RETENTION OF PERSONAL INFORMATION

We will retain your Personal Information as long as reasonably necessary for purposes for which the Personal Information was collected and is used by us, as stated in this Policy, and for an additional period of time as necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements. 

To determine the appropriate duration of the retention of Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of Personal Information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting, and other applicable obligations.

Once retention of the Personal Information is no longer reasonably necessary for the purposes outlined above, we will either delete or deidentify the Personal Information or, if that is not possible (for example, because Personal Information has been stored in backup archives), we will securely store the Personal Information and isolate it from further active processing until deletion or deidentification is possible.

SOURCES OF PERSONAL INFORMATION

We may collect Personal Information directly from individuals, automatically from your devices, and from our third-party partners.  

  • Information Collected Directly. We collect Personal Information when you engage with Vi Labs or its service providers directly, such as when registering for a service, requesting information from us, or when you contact us or otherwise voluntarily provide information to us.
  • Information Automatically Collected or Derived. Vi Labs may also derive or automatically collect information, which may be considered Personal Information, including related to you and your use of the services and our website and other websites. This may include data collected via cookies or other similar technologies. See the Cookies, Targeting, and Analytics section below for more information.
  • Information From Third-Party Partners. We also collect Personal Information from government entities, market research companies, advertising networks. social networks, our customers, consumer data resellers, and healthcare clearinghouses. 

COOKIES, TARGETING AND ANALYTICS

We, and other authorized third parties, may collect information about your use of our website and other nonaffiliated websites over time through the use of cookies and other similar technologies. 

We may also work with third-party advertising networks and advertising providers parties who serve ads on our behalf and on behalf of our customers and who collect information about visitors to our websites and other websites and apps over time. You may visit the Digital Advertising Alliance’s Webchoices tool here and the Network Advertising Initiative’s Opt Out Choices tool here to learn how to opt out of such interest based advertising on websites by companies participating in these programs. Opting out of interest-based advertisements does not eliminate all advertisements. The advertisements will still appear but may no longer be relevant to your interests. 

We work with third parties, including Google Analytics, to understand how individuals use and interact with the websites, improve the performance of the websites, and for analytics purposes. Depending on your browser, you may disable cookies in your browser settings. Remember, your cookie preferences and browser settings are specific to each device you use, and you will have to renew your cookie preferences for each of your devices or browsers.

If you choose to refuse all cookies, some of the features of our website may not function as intended.

DISCLOSURES OF PERSONAL INFORMATION

We disclose Personal Information with the following categories of third parties for our business and commercial purposes:

  • Service providers and suppliers who process Personal Information to provide services to Vi Labs, including customer relationship management tools, email providers, and database hosting services;
  • Customer of Vi Labs who receives Vi Labs’ Data Services to allow them to identify and market to new and existing customers;
  • Our affiliates and subsidiaries for certain purposes described above; 
  • Digital analytics providers to help measure and analyze user interactions with the websites;
  • Advertising providers for marketing and advertising purposes;
  • Our advisors, including our lawyers, accountants, and auditors who provide services to Vi Labs;Government entities, regulators, or pursuant to legal processes, including in response to a subpoena, court order, or similar legal process or to protect or defend our rights or those of others;
  • Business transactions, including in the event of a merger, reorganization, bankruptcy, or similar corporate restructuring activity; and
  • With your consent or as otherwise disclosed at the time of collection or sharing.

ADDITIONAL INFORMATION FOR RESIDENTS OF CERTAIN U.S. STATES

Depending on your state of residence, you may have the following rights with your respect to your Personal Information, subject to certain exceptions and limitations:

  • Confirm: You may request that we confirm whether we are processing Personal Information about you. 
  • Know or Access: You may have the right to know and access the Personal Information we have collected about you, including the categories of Personal Information collected, the categories of sources from which the Personal Information is collected, the business or commercial purpose for collecting, selling, or sharing Personal Information, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we have collected about you.
  • Third Party Disclosures: You may request a list of nonaffiliated third parties or categories of third parties (excluding our vendors and service providers) to whom we have disclosed Personal Information. 
  • Portability: You may request a portable and readily usable copy of the Personal Information we have collected about you, subject to certain limitations and exceptions.
  • Delete: You may have the right to ask us to delete the Personal Information we have collected about you.
  • Correct: You have the right to request we correct inaccurate Personal Information we maintain about you.
  • Opt Out of the “Sale” or “Sharing” of Personal Information: You can opt out of sales of Personal Information or sharing for cross-context behavioral advertising or targeted advertising purposes. 
  • Non-Discrimination: We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy.

To submit a request to exercise any such rights, please use one of the following options:

Residents of certain states who believe we have not acted on their request may appeal our decision by calling us as described above or emailing us at privacy@vi.co with the subject line “Privacy Rights Appeal.”

To the extent required by applicable law, we will honor an opt-out preference signal recognized by Vi Labs, such as a Global Privacy Control signal, as a valid request to opt out of the sale or sharing of Personal Information. 

In some instances, we will need to verify your identity before honoring your privacy right requests. At a minimum, we will request your name, contact information (such as email address or phone number), and your relationship with us. 

You may also designate an authorized agent to submit a privacy rights request on your behalf. To do so, you may ask that you provide that authorized agent written and signed permission to submit such request or demonstrate power of attorney. 

CALIFORNIA SHINE THE LIGHT

If you are a California resident, we will not disclose your Personal Information to third parties for their own direct marketing purposes, if you have exercised your right to opt-out of such disclosures. To exercise this opt-out right, please contact us at privacy@vi.co. 

AGGREGATE AND DE-IDENTIFIED DATA

We may also collect, use and disclose aggregate and de-identified data without limitation. Where we use, disclose or process de-identified data, we will maintain and use the information in de-identified form and not to attempt to reidentify the information, except as permitted by applicable privacy laws.

THIRD-PARTY LINKS AND SERVICES

We may offer links to or from our websites or online services as well as to websites, services, and resources operated by third parties. We are not responsible for the privacy practices, content or policies of websites operated by third parties and encourage you to review their privacy and information sharing practices before providing any information. 

CHANGES

The “Effective Date” at the top of this Policy indicates when this Policy was last updated. We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
